SUBJECT: Title Revocation Affidavit for Incorrect Manufacturer’s Certificate of Origin (MCO)
Surrendered
PURPOSE
To clarify department handling of requests to revoke titles when a licensed franchise dealer surrenders the
incorrect MCO with a title application.
DETAILS
Licensed franchise dealers who surrender the incorrect MCO resulting in the wrong vehicle being titled may
request the Texas Department of Motor Vehicles (TxDMV) revoke the title by submitting an affidavit to the
TxDMV. The Title Revocation Affidavit for Incorrect Manufacturer’s Certificate of Origin Surrendered
(Form VTR-18) has been created to facilitate the revocation, and is available on the TxDMV website. An
affidavit stating the relevant facts may be submitted in lieu of Form VTR-18.
Licensed franchise dealers may submit a completed Form VTR-18 along with the original, incorrect Texas
Certificate of Title (if the Texas Certificate of Title has already been issued). If the dealer is unable to
provide the original Texas Certificate of Title because it is lost or stolen, the dealer may sign the certification
on the Form VTR-18. TxDMV reminds dealers that any MCO surrendered to the county tax assessor-
collector’s office cannot be returned.
If a lien has been recorded, the lienholder will provide a release of lien, letter of no interest, or complete the
Lienholder Acknowledgement section on the Form VTR-18 to inform the TxDMV that their interest in the
vehicle is released. It is not necessary for a paper title to be requested if the title is an electronic title.
COUNTY ACTION
Instruct licensed franchise dealers requesting a title revocation due to surrendering an incorrect MCO to
submit a Form VTR-18 or an affidavit stating the relevant facts and all supporting documents to the TxDMV.
MOTOR VEHICLE DEALER ACTION
Ensure the correct ownership evidence and all required documents are being submitted when applying for
title. Submit a Form VTR-18 or an affidavit stating the relevant facts and all supporting documents to
TxDMV as soon as possible upon identifying the incorrect MCO was surrendered with a title application.
