SUBJECT: Revised Title Revocation Rule for a First Sale
PURPOSE
To provide revised information on a title revocation for a first sale.
DETAILS
Effective July 1, 2020, an amendment to Title 43 of the Texas Administrative Code, §217.11,
extends the timeframe for a licensed motor vehicle dealer to request the Texas Department of
Motor Vehicles (TxDMV) revoke the title application for a first sale from 21 days to 90 days.
The existing process for a licensed motor vehicle dealer to request the revocation has not
changed. The Title Revocation Affidavit for a First Sale (Form VTR-17) has been revised with
the new timeframe.
A title application cannot be revoked after 90 days, and this deadline cannot be circumvented
through a lawsuit. The Texas title should be used to facilitate any subsequent transfer if a
properly completed Form VTR-17 is not submitted to the TxDMV within 90 days.
COUNTY ACTION
Instruct licensed motor vehicle dealers requesting revocation of a first sale to submit Form VTR-
17 and all required documents to the department within 90 days of the date of sale.
MOTOR VEHICLE DEALER ACTION
Ensure a completed Form VTR-17 and all required documents are submitted to the department
within 90 days of the date of sale when requesting revocation of a first sale. If the request is not
submitted within 90 days, obtain the properly assigned Texas title from the purchaser to sell the
vehicle.
