SUBJECT: Guidance for the Transition of COVID-19 Protocols for Long-Term Care
Ombudsman Programs
Since the onset of the COVID-19 outbreak, the Office of the State Long-Term Ombudsman
(OSLTCO) has followed California Department of Public Health (CDPH) guidance and
directives, which lead with science and data to better understand COVID-19. Following the
end of the COVID-19 State of Emergency on February 28, 2023 and the termination of
several State Public Health Orders on March 3, 2023, OSLTCO is issuing this updated
guidance to local LTCOP staff and Ombudsman representatives.
1. Vaccination and Booster Requirements
Effective April 3, 2023, State Public Health Officer Order, the Health Care Worker Vaccine
Requirement was terminated. As a result, there is no longer a COVID-19 vaccination and
booster requirement for workers who provide services or work in Adult and Senior Care
(ASC) facilities, including Ombudsman representatives.
While no longer a requirement, OSLTCO strongly encourages all Ombudsman
representatives to stay up-to-date with COVID-19 vaccinations and boosters, as per current
CDC guidance, as this remains the most important strategy to prevent serious illness and
death from COVID-19.
Program Memo Summary:
This Program Memo (PM) details the most recent COVID-19 safety protocols for the Long-
Term Care Ombudsman Program (LTCOP). This PM supersedes PM 23-03, dated January
14, 2023 and PM 21-17, dated September 24, 2021 and provides information on the end of
vaccination and booster requirements, vaccination verification, testing, and end of the
masking requirements for the LTCOP.

2. Vaccination Verification
LTCOP Coordinators are no longer required to verify the vaccination status of Ombudsman
representatives and staff. However, vaccination records currently on file should be retained
in accordance with Chapter 18, Section VII of the Ombudsman Program Manual.
3. Testing
Ombudsman representatives are no longer required to complete a COVID-19 self-
assessment form or undergo SARS-CoV-2 diagnostic screening testing before providing
services in LTC settings.
However, any Ombudsman representative, regardless of vaccination status, who is
experiencing COVID-19 symptoms or had COVID-19 exposure is expected to follow CDC
guidance on preventing the spread of COVID-19, including getting tested if symptomatic and
staying at home except for medical care. LTCOP Coordinators are not required to notify the
OSLTCO of the results of COVID-19 testing of local program staff and volunteers.
4. Personal Protective Equipment (PPE)/ Masking
On March 3, 2023, CDPH announced the end of the masking requirements in the CDPH
Guidance for the Use of Face Masks. Beginning April 3, 2023, the CDPH Guidance for the
Use of Face Masks are recommendations determined by community case levels.
Effective mask wearing is still an essential tool in California's fight against COVID-19. Masks
help protect the mask wearer and others from virus exposure. All Ombudsman
representatives, regardless of vaccination status, are thus highly encouraged to wear
appropriate personal protective equipment, including masks, and practice hand hygiene
(hand washing, use of antiseptic handwash or alcohol-based hand rub) upon entry to and in
all common areas of the facility when community case levels are elevated.
There may be masking requirements for facility staff and other workers who provide services
or work in ASC facilities, including Ombudsman representative, that are more strict than the
CDPH Guidance for the Use of Face Masks (see also COVID-19 Prevention Non-
Emergency Regulations). Ombudsman representatives should follow the strictest
requirements.

Reminders
As a reminder, Ombudsman representatives:
Must provide all regular LTCOP duties and conduct unannounced indoor visits to long-
term care facilities, including those with positive COVID-19 cases.
Must be free of COVID-19 and/or other contagious diseases, don appropriate PPE
before and practice hand hygiene while conducting facility visits.
Must follow the strictest health department guidance in their local area. If there are
differing requirements between the most current CDC, CDPH, CDSS, and local health
department guidance or health orders, Ombudsman Representatives should follow the
strictest requirements. The program Coordinator may contact OSLTCO for more
information or guidance.
